InterVac Design Corp. Maintenance Packages – Terms & Conditions

Overview

These Terms & Conditions govern your enrollment in and participation in any InterVac Maintenance Package.

You agree to these Terms when you enroll, submit payment, receive shipments, or use any Plan benefit. If you do not agree, do not enroll or use the service.


Acceptance of Terms

By enrolling in a Plan, you accept these Terms in full without limitation.

You also accept these Terms when you:

  • Submit payment
  • Receive any shipment
  • Use any Plan benefit

If you do not agree, you must cancel before enrolling or using the Plan.


Incorporated Policies

These Terms include and enforce the following policies:

  • Refund & Returns Policy
  • B2B Brand Protection & MAP Policies
  • Owners Manuals & Usage Instructions
  • Contact & Support Information

If any conflict exists, these Terms control.


Changes to Terms

IVD may update these Terms at any time.

We will provide at least 30 days’ notice by email or website posting. If you continue using the Plan after that period, you accept the updated Terms.

If you do not agree, you must cancel before the changes take effect.


Definitions

The following definitions apply:

  • Plan: Any subscription-based maintenance package offered by IVD
  • Original Purchaser: The first buyer of a new InterVac product from IVD or an authorized dealer
  • Factory Warranty: The standard 2-year limited warranty
  • Misuse or Abuse: Any use that violates product guidelines or voids the warranty
  • Claim: A request for parts, service, or Plan benefits
  • Enrollment Date: The date IVD approves and activates your Plan
  • Claim Resolution Date: The date IVD fulfills an approved claim

Eligibility & Enrollment

Eligibility is strict. IVD may approve or deny enrollment at its sole discretion.


General Requirements

You must meet all of the following:

  • You are the Original Purchaser
  • The product is new, unused, and undamaged
  • You are at least 18 years old
  • You reside in the continental United States
  • You enroll within 30 days of purchase

You must also provide accurate and complete contact information. Any mismatch or suspicious activity will result in denial.


Additional Requirements for InterVac Care+

For Care+ plans:

  • The unit must still be within the 2-year Factory Warranty
  • You must provide valid proof of purchase or manufacture date
  • IVD must verify and approve your documentation before coverage begins

A mandatory 90-day waiting period applies before any claim can be submitted.


Ineligible Products

The following are not eligible:

  • Used, refurbished, or resold products
  • Products with pre-existing damage or modifications
  • Products using non-genuine parts

Plans are non-transferable. If ownership changes, the Plan terminates immediately without refund.


Enrollment Process

To enroll:

  1. Submit your application through the website or email
  2. Provide all required documentation
  3. Wait for IVD approval

If IVD denies enrollment, we will issue a refund within 14 days minus a $10 administrative fee.


Payments & Billing

Pricing Structure

Pricing reflects the rates listed on the website at the time of enrollment.

  • Annual prepay offers the lowest cost
  • Monthly billing includes a 15% premium

Auto-Renewal

Plans renew automatically unless you cancel.

IVD will send notice 30 to 60 days before renewal when required by Florida law. If you do not cancel, you accept the renewal.


No Refund Policy

All payments are non-refundable except:

  • Within 14 days of enrollment if no shipments or claims occur
  • When IVD initiates termination

No refunds apply after shipments, claims, or partial use.


Failed Payments

If a payment fails:

  • IVD will notify you
  • You have 15 days to update payment details
  • The Plan terminates after 30 days of non-payment

Late fees may apply after 15 days.


Chargebacks & Disputes

If you initiate a chargeback:

  • IVD will terminate your Plan immediately
  • You will owe all disputed amounts and fees
  • IVD may charge a $50 administrative recovery fee
  • You may be banned from future services

Deliveries & Products

IVD ships genuine InterVac bag packs 1 to 3 times per year based on your plan.

  • Shipping is free within the continental United States
  • Delivery timing may vary due to external factors
  • All shipments are final and non-returnable

IVD is not responsible for delays, loss, or carrier issues.


Warranty & Service Coverage

Bags Essentials

This plan does not include warranty, service, or parts coverage.


InterVac Care+

This plan provides:

  • Parts-only coverage for defects
  • Coverage for the vacuum unit and listed accessories

Coverage does not include normal wear items such as bags or filters.


Activation Requirements

Coverage begins only after:

  • IVD verifies eligibility
  • The 90-day waiting period ends

Installation Limitations

IVD does not cover installation issues.

  • OEM installations fall under the manufacturer
  • Aftermarket installations are not covered unless a defect exists

Abuse & Warranty Voids

Coverage ends immediately if misuse occurs.

If voided, a $75 parts deductible applies. IVD determines all warranty decisions.


Claims Process

To submit a claim:

  • Use the customer portal or email
  • Provide complete documentation

IVD will respond within 7 business days.

Approved claims include parts shipping only. Customers handle installation.


Claim Limits

  • One free claim per year
  • Additional claims require a $25 fee
  • 90-day waiting period applies to all claims

Inspection Rights

IVD may request product inspection at any time.

If abuse or fraud is confirmed:

  • The claim will be denied
  • The Plan will terminate

Fraud & Abuse

IVD enforces a zero-tolerance policy.

If fraud occurs:

  • The Plan terminates immediately
  • No refund will be issued
  • Legal action may follow

Post-Claim Commitment

After a claim is approved, you must maintain the Plan for 6 months.


Post-Cancellation Recoupment

If you cancel within 12 months of a claim:

  • You must repay all related costs
  • A $150 administrative fee will apply

Excessive Use

If support or claims exceed reasonable limits:

  • IVD may charge a $50 administrative fee
  • IVD may limit or terminate service

Suspension

IVD may suspend your Plan for up to 30 days during investigations.

No credits or refunds apply during suspension.


Termination

IVD may terminate any Plan at any time.

To cancel your Plan:

  • You must call IVD directly
  • Email or online requests are not accepted
  • A 30-day notice period applies

Legal & Dispute Resolution

Governing Law

Florida law governs these Terms.


Dispute Resolution

All disputes will be resolved through binding arbitration in Palm City, Florida.


Liability Limits

IVD limits liability to the total amount paid within the previous 12 months.

IVD is not liable for indirect or consequential damages.


General Provisions

Privacy

IVD handles all personal data according to its Privacy Policy.


Force Majeure

IVD is not responsible for delays caused by events outside its control.


Severability

If any section becomes invalid, the remaining Terms remain enforceable.


Entire Agreement

These Terms represent the full agreement between you and IVD.
